MINUTES OF MEETING
This meeting was held online due to the covid-19 pandemic
Present:
Councillors: Bob McCann (Chairman), Colin Appleton, Derek Baxter, Sandra Baxter, Maria Bennett, Dawn Brodie, David Dutton, Dave Irving, Yvonne Irving, Susan McCann, Bernie Prescott, Carol Richards, Joe Riley, Mike Weild and Paul Wiencke
In Attendance: Claire Jenkins (Clerk), Jill Hendry (Administrative Assistant) and 1 member of public.
36.0 Apologies for Absence
There were no apologies received.
37.0 Members Declaration of Interest
Cllr Bob McCann declared an interest in planning matters.
38.0 Public Forum
The meeting was adjourned for this item.
There were no members of the public wishing to address the Council.
The meeting was reconvened.
39.0 Minutes of the Previous Meeting
It was resolved that the minutes of the meeting held on 4 August 2020 were approved as a correct record. As the meeting was held online, the Clerk will arrange for the minutes to be signed.
40.0 Matters of Report from Previous Meeting
Cllr McCann reported that the application for the Rights of Way at St Luke’s Church Road will be heard at the Licencing Committee meeting on Monday 7 September 2020.
Members raised concern about points in the report regarding the original application by Formby Civic Society stating that it had been withdrawn. In the Formby Civic Society minutes and newsletter at that time, it was noted that the application had been a success and the pathways would be added to the definitive map. Further information will be requested from the Rights of Way Officer.
41.0 Planning Applications
Members discussed the planning applications on Sefton’s weekly list and noted the following:
41.1 43a Freshfield Road – Objections raised due to overdevelopment of the site.
41.2 27 Timms Lane – Plans for 3 storey high house, objections raised due to the size and out of keeping with the area.
41.3 2B Piercefield Road – extension of house, objections raised due to over development of the site.
Members discussed the new permitted development legislation. Concerns were raised over proposed legislation overruling the Neighbourhood Plan and Sefton Local Plan. (The Government have issued a White Paper on Planning reforms which are proposing considerable changes)
42.0 To discuss and approve the following:
42.1 To discuss the residents’ complaints about excessive noise levels from the piling of the Liverpool Road Site development and to decide whether to undertake an independent noise survey up to an amount of £2,000.
Members discussed the noise levels. On receipt of complaints, Environmental Health have been to the site and obtained readings which the developer have taken themselves. The developers own readings show that the levels are within tolerances, however, reports from residents is of intolerable noise levels. Cllrs have been to site late evening to witness this. Members discussed the different types of piling equipment and noted that the developer has been asked for their method statement in determining which type of equipment to use. It was noted that some equipment is not considered suitable for use near existing properties. Members discussed options for noise survey work to be taken from an independent company and these readings to be sent on to Environmental Health to be compared.
It was resolved to seek independent advice and to commission an independent noise survey up to an amount of £2,000.

It was resolved to make the payments as listed above.
