MINUTES OF MEETING

Present: Councillors: Bob McCann (Chairman), Colin Appleton, Derek Baxter, Sandra Baxter, Maria Bennett, Dawn Brodie, David Dutton, Dave Irving, Yvonne Irving, Bernie Prescott, Carol Richards, Joe Riley, Mike Weild and Paul Wiencke.

In Attendance: Claire Jenkins (Clerk) and 0 member of public.

31.0 Apologies for Absence

There were apologies received from Cllr S McCann.

32.0 Members Declaration of Interest

Cllr Appleton declared an interest in item (36.1 and 37.2). Cllr Brodie declared an interest in item (37.1)

33.0 Public Forum

The meeting was adjourned for this item.

34.0 Minutes of the Previous Meeting

34.1 Minutes of the Ordinary Meeting held on 25 May 2021

It was resolved that the minutes of the meeting held on 25 May 2021 were approved as a correct record and will be signed by the Chairman.

It was resolved that the minutes of the meeting held on 2 July 2021 were approved as a correct record and will be signed by the Chairman.

35.0 Matters of Report from Previous Meeting

35.1 Cllr B McCann and the Clerk met with the aboriculturalist to look at the village trees. The old chestnut trees received further injections of the BITE infusion, however the health of one of the trees is of concern and at the time of the visit the trees were suffering from lack of rainwater.

36.0 Planning Applications

36.1 The Formby Tennis club originally applied for a paddle board court, which was objected to. A modified application has been submitted showing a new location and the drawings now include a large 6m high canopy over the court. Cllrs questioned whether the canopy was in keeping with the residential area and will review the revised application.

36.2 Lunts Lane Footpath, Liverpool Road to Savon Hook is closed but members noted that no diversion has been put in place.

36.3 Brackenway objections have been submitted.

36.4 National Trust plans for car parking at Victoria Road.

It was noted that a new car park is planned to be built near toilet block and existing car park to be removed. Owners of the caravan site had complained to FPC regarding the planned closure of the road leading from the existing car park to the caravan site. The Chairman and the Clerk met with the owners and the Clerk has written to the Regional Manager to ask what alternative access routes are being considered. Cllr Irving reported that it was stated at a recent stakeholder meeting that the National Trust was committed to maintaining the caravan park.

36.5 Liverpool Road development site.

Formby Parish Council have been in discussion with Environmental Health regarding the noise and vibration caused by the building works on the development. Environmental Health served a notice on the developer regarding the noise levels. Piling has re-commenced using a different piling method and Environmental Health have installed noise and vibration monitoring equipment in residents houses. The sewage station application was approved.

36.6 Illegal waste construction processing plant.

The enforcement notice was issued and stated that the land must be returned to its original condition. The companies have now left the site. The time limit to reinstate the site to green belt land has been extended to 19 July. It was noted that the Football club owner had stated that the remaining soil would be used for football pitches. The Environment Agency report has said that this cannot be used for football pitches as there were no consignment notes to show where the soil came from. A response is awaited from Sefton to confirm what actions they are taking to ensure the enforcement notice is complied with.

37.0 To discuss and approve the following:

37.1 To approve a donation of up to £5000 for the Radio City Cash for kids’ application for the purchase of bleed control kits and housing boxes for the Formby area, with the proviso that the locations are agreed with the Parish Council.

37.2 To discuss the proposal for a lease agreement with Sefton Council for the Former Holy Trinity Playing Fields at Lonsdale Road and to approve a response to include a rough idea of what improvements or facilities/equipment could be provided to justify the lease.

The Chairman and Cllr Irving have had discussions with residents from Rosemary Lane and Lonsdale Road, Formby Village Tennis Club and Formby Little Theatre. Ideas have been expressed for trees, walkways through meadow grass, an area for Formby Little Theatre to create an outside stage for shows, or to serve tea and coffee. It was noted that the residents are not in favour of a playpark and the issue of on street parking was raised. Members discussed the Commemoration of the Queens Jubilee and suggested possibly planting 70 small trees/bushes in collaboration with Ward Cllrs. It was discussed that the park should include benches along the walkways and the Queen Elizabeth II Jubilee Park was suggested as a name. Cllrs discussed the term of the proposed lease and recommended 99 years. The Clerk will report to Sefton Council the suggested improvements and suggested lease period.

37.3 To note the cost of legal advice of £720 as per the finance minutes of 16 June 2021.

37.5 To note the situation in relation to the caravan site at Formby National Trust Victoria Road site.

37.6 To resolve that pursuant to section 1(2) of the Public Bodies (Admission to meetings) Act 1960 it is resolved that, because of the confidential nature of the business to be transacted, the public and press leave the meeting during consideration of the tenders received for the Christmas lights display.

It was resolved to approve the recommended tender and authorise Sefton Street Lighting to award the contract for 2021/22.

38.0 Payments

It was noted that following the resolution to proceed with a Judicial Review as per the minutes of the meeting held on 2 July 2021, an amount of £8000 was requested to be paid on account to the solicitors acting for the Parish Council. This is inclusive of the amount noted at 37.4.

It was resolved to make the payments as listed above.
